BUYING OR SELLING BRITISH BIRDS

In the light of recent prosecutions the Council, at its AGM, agreed to take further positive action to assist breeders and offer further advice in connection with selling or exchanging of any birds.

 

We have always stressed the importance of records and although the Act does not specifically require records to be kept , it is implicit in the current legislation that there has to be some burden of proof on bird keepers that the birds, and their parents, were legally in captivity at the time of breeding, as has been shown in recent cases before the courts.

 

 

In addition any species not listed on schedule 3 when offered for sale, sold or purchased requires proof of breeding documentation. This need not be a complicated arrangement and we have produced a simple form which could be used to assist you. This form is attached and could be altered to your own fashion and used either as a breeding form for your own use or as proof of breeding form when selling non schedule birds.

 

There is also guidance available from Natural England on a recently published draft document which members may not be aware of and we have copied the guidance below. This guidance is for use with non schedule 3 species.

 

We are still in discussions with DEFRA and it is very much work in progress on the whole issue of schedules, rings, licencing and other areas affecting possible changes to the act but as with many government department’s time does not seem to be of the essence! 

There is also a move under foot to have a judicial review of the 1981 Act which presently  puts the burden of proof on the keeper of the bird to prove it is legal, rather than on the prosecution to prove that it is illegal. A group of likeminded individuals and organisations have been asked to support and contribute to this initiative and the Council delegates agreed to provide whatever support we could.

Guidance on documentary evidence of captive breeding from Natural England.

Persons intending to rely on the general licence must be able to demonstrate that birds are legally held and captive bred, and are advised to – only purchase birds from breeders who are able to satisfactorily demonstrate that they are complying with the relevant regulations , to confirm in so far as they are able, the bird’s identification and age are correct, to check that the bird is correctly ringed and to always obtain signed and dated written documentary evidence of captive breeding from the breeder. Documentation should cite the bird’s species, ring number and any other identification mark, hatch date, along with similar details for the parent birds and the breeders contact details.

SHOW CAGE PAINT COLOUR CHANGES

Due to the unavailability of Brolac Georgian Green the internal colour of the Standard Hardbill and Mule & Hybrid cages has now changed.

The new colour agreed at the 2010 AGM will be Leyland Emerald or BS 14E 53

 

As this new colour is almost identical to the old one no changes are required to older cages. until they require repainting, this new colour is also a British Standard colour, quoting this BS number at most good paint outlets should make this colour readily available.

 RINGS & GENERAL LICENCE ANNOUNCEMENT

Rings are dispatched in padded envelopes, postal damage is unlikely, but rings should be checked on arrival.  Please note a slight misalignment of digits or a slight flaking of white inlay does occur in manufacture and should not be a matter of concern as it is totally different to damage caused when a ring is tampered with.

Users of General Licences should make themselves fully aware of conditions of the licence they use.  Copies of General Licences can be obtained by post from Wildlife Licensing Unit, Natural England,1st Floor, Temple Quay house, 2 The Square, Bristol BS1 6EB  or can be accessed on website www.naturalengland.org.uk   Tel No. 0845 6014523.

Species listed on Schedule 3 part 1 of the Wildlife and Countryside Act are permitted under legislation to be offered for sale or competitively shown if ringed in accordance with ringing regulations i.e. Captive Bred and ringed with the correct size ring issued by the B.B.C. or I.O.A.

Note Schedule 3 part 1 species not ringed in accordance with ringing regulations must be individually licensed by Natural England if they are to be offered for sale or competitively shown.  Application form link http://www.naturalengland.org.uk/ourwork/regulation/wildlife/licences/applicationforms.aspx

General Licence WML/GEN L14 permits the competitive showing of species not listed on Schedule 3 part 1 subject to conditions of this licence.  Note proof of breeding documentation is a condition of this licence.

General Licence WML/GEN L15 permits sale and competitive showing of Mealy Redpoll (Carduelis flammea flammea) provided it is ringed with size C ring issued by B.B.C. or I.O.A. Note documentation is not now a requirement of this licence.

General Licence WML/GEN L18 permits sale of species not listed on Schedule 3 part 1 provided conditions of the licence are met.  Note proof of breeding documentation is a condition of this licence.

 

 
     
 

 

C.O.M. I.D. CODED RINGS CAN NOW BE ORDERED FROM THE BBC,

 

If you would like to show your birds abroad at the world show for example, we can now supply you with the rings,  The BBC has affiliated to C.O.M Great Britian to allow all our members birds rung with the new BBC, C.O.M I.D coded and coloured with C.O.M year colour rings to compete at worldwide events, see our downloads page for order form and ring sizes chart.

 

Colour Coded rings have a six year cycle:

 2009 Violet , 2010 Orange , 2011 Dark Blue ,2012 Red ,  2013 Black , 2014 Light Green .

From 2015 the cycle restarts with Violet etc.
